How Rosemary Nelson became loyalist hate figure

Rosemary Nelson would have gone unnoticed in almost any other town in Northern Ireland.

Like many solicitors, she would have spent most of her time dealing with clients charged with minor criminal offences, buying and selling property, matrimonial disputes and personal injury claims.

She would have occasionally been mentioned in local newspaper articles, but her name wouldn't have stood out from the crowd.

But Lurgan isn't any other town. Throughout the Troubles it was embroiled in a cauldron of sectarian and political turmoil in Mid-Ulster and Rosemary Nelson found herself propelled into the spotlight because of the clients she represented.

They included leading republican Colin Duffy, who is currently in jail charged with the murders of two soldiers in Antrim in March 2009.

She also represented the residents of the Garvaghy Road in Portadown in their efforts to prevent an Orange Order parade passing through their area, and the family of Robert Hamill, a Catholic killed by a loyalist mob in Portadown.

Hate figure

The 40-year-old mother of three became a hate figure for hardline loyalists and, it was claimed, for some police officers.

The solicitor, some of her friends and a number of organisations, raised concerns about her safety over a two-year period before she was killed.

She was told by a number of her clients that RUC officers had made her the target of abusive, insulting and demeaning remarks when they were being questioned.

It was claimed that some officers had directly and indirectly threatened her life.

Mrs Nelson was the target of a loyalist smear campaign. They accused her of being linked to the IRA and issued threats in a number of anonymous calls and letters to her office and home.

In September 1998, six months before she was killed, Mrs Nelson travelled to Washington and outlined her concerns while giving evidence to the House Committee on International Operations and Human Rights in Northern Ireland.

In her testimony, she said: "Since I have begun to represent clients detained for politically motivated offences and especially since I became involved in a high profile murder case I have begun to experience difficulties with the RUC..."

Others also expressed concern, and called on the RUC and the government to take steps to protect her.

They included the Garvaghy Road Residents' Committee, American Lawyers Alliance for Justice in Northern Ireland, Amnesty International, British Irish Rights Watch, and the Belfast-based human rights group the Committee on the Administration of Justice.

They documented 20 different incidents over a two-year period. They included seven separate death threats, two of which were alleged to have been made by RUC officers.

On the morning of 15 March 1999, a bomb exploded under Mrs Nelson's BMW car just yards from her home in Lurgan. She died hours later from the horrific injuries sustained.

A loyalist paramilitary group, the Red Hand Defenders, said it planted the bomb. But her family, friends and many of those who had raised concerns about her safety pointed an accusing finger at the RUC, and called for a public inquiry.

A retired Canadian judge, Peter Cory, was asked to investigate allegations of collusion by members of the security forces in the murder and a number of other high profile killings, including those of solicitor Patrick Finucane, Portadown man Robert Hamill, and loyalist leader Billy Wright.

In a report published in April 2004, he recommended inquiries into all four murders.

Dealing with the Nelson killing, he said: "I am satisfied that there is evidence of collusion by governmental agencies in the murder that warrants holding a public inquiry."

He added: "Without public scrutiny doubts based solely on myth and suspicion will linger long, fester and spread their malignant infection throughout the Northern Ireland community."

Four years later, an inquiry into the circumstances surrounding her murder began hearing oral evidence.

The panel heard 130 days of testimony and also gathered tens of thousands of documents, and took witness statements from more than 350 people.

A public inquiry into the murder of solicitor Rosemary Nelson in Northern Ireland is set to release its findings, 12 years after she was killed in a loyalist bomb attack.
The inquiry has examined claims that police made threats against the lawyer, plus allegations of security force collusion in her killing.
The 40-year-old mother-of-three died when a bomb exploded underneath her BMW car as she left her home in Lurgan, Co Armagh, on March 15, 1999.
Her legal practice dealt with mainly routine cases but she had risen to prominence and earned dangerous enemies after taking on a number of high profile clients, including suspected republicans.
Mrs Nelson's murder came within a year of the signing of the Good Friday Agreement, but it was an unstable period. As decades of violence gave-way to a new era of political negotiation, warring ideologies feared losing advantage.
The solicitor found herself representing clients whose cases placed her at the centre of some of the most controversial episodes of the period.
They included Lurgan republican Colin Duffy, who in the 1990s was acquitted of the murder of a former soldier, while claims he killed two police officers also collapsed. He is currently charged over the murder of two soldiers shot dead by dissident republicans in Antrim in 2009.
Other clients include the nationalist Garvaghy Road residents' group as it opposed Orange Order parades in the bitter Drumcree stand-off in Portadown.
As tensions grew, Mrs Nelson claimed that Royal Ulster Constabulary (RUC) officers questioning her clients had made death threats against her. That alleged misconduct matched that reported by Belfast solicitor Pat Finucane before he was shot dead by loyalists in 1989.
Mrs Nelson's murder was claimed by the loyalist Red Hand Defenders, but her death sparked immediate claims of a possible security force link. In 2001 a review of the case by retired Canadian judge Peter Cory found sufficient "evidence of collusion by government agencies" to warrant a public inquiry.

These protests will be held in tandem with other protests taking place the same day in Ireland in support of the POWs at Maghaberry jail, who have endured over 60 brutal forced strip searches over the past several months and who are now on dirty protest at the jail. We are also highlighting t...he cruel and inhumane detention at Maghaberry of dying republican prisoner Brendan Lillis who is being held without charge and has been bedridden since his internment in 2009.

DATES FOR QUEENS PROTEST MARCHS

Republican Sinn Féin will be holding a series of protests during the visit of the Queen of England to Dublin on May 17/18 and in Kildare on May 19.

On May 17 Republican Sinn Féin will assemble at the Black Church, St Mary’s Place (facing Granby Row and the Maldron Hotel) in Upper Dorset St at 12 noon. (Garden of Remembrance).

On Wednesday May 18 we will assemble at the junction of Summerhill Parade and Portland Row at 12 noon. (Croke Park).

On that evening (of May 18 we will assemble at the junction of New St and Nicholas St near St Patrick’s Cathedral at 5pm. (Dublin Castle).

On Thursday May 19 in Kildare Town at 10am in the Market Square. (National Stud)

PROTEST ACTION HAS COMMENCED.

On Friday 6th May 2011 at 10pm republican prisoners started protest action against the failure of gaol admin/NIO to implement the 12th August 2010 agreement.

Shortly after they began protest action the riot squad entered their cells and attacked them before physically removing the prisoners. The prisoners were trailed out of their cells and along the landing.

3 prisoners, John Paul Wottoon, Mark McGuigan and Gerard McManus were stripped naked by the riot squad and then trailed around their cells (through the debris of the broken sink and toilet etc) before being trailed along the landing.  They have received injuries as a result.

The prisoners were then separated from the other prisoners not on protest, and are now on a different landing. Their cells have been stripped bare and they have no access to dry clothing. The sewage system is now faulty which means that when the other prisoners flush their toilets all the toilet waste is now flooding into their cells.

Since Friday night the prisoners on protest have been locked up under rule 7, and have not been able to make contact with their families. Gerard Mc Manus’ family were refused their family visit yesterday (Sunday).

Today the prisoners were informed that rule 7 had been lifted and that they would all be allocated 5mins to make a phone call.
